Terms and Conditions

The following Terms and Conditions apply to all contracts, deliveries, and other services. Any supplementary agreements require our written confirmation.
1. Scope
Within Austria and EU countries, dietary supplements are shipped by Coropharm (hereinafter referred to as the “Sender”).
Contracts, offers, deliveries, and services provided by the Sender are exclusively based on these Terms and Conditions. These Terms and Conditions are considered accepted upon submission of the order by the customer.
The Terms and Conditions may be amended at any time. The version in effect at the time the order is received by the Sender applies.
2. Disclaimer
All information and statements contained on our websites have been carefully researched and verified by the Sender or third parties. They are provided to users solely for general informational purposes and are non-binding. The same applies to all oral and written statements regarding possible uses and effectiveness of the products. These are provided to the best of our knowledge. The Sender expressly points out that this information does not replace an examination by a doctor or consultation with a psychologist or psychiatrist. Neither the Sender nor the relevant third parties guarantee the accuracy, completeness, or timeliness of the information. The Sender assumes no liability for any damages of any kind that may result directly or indirectly from the use of the applications/products presented.
The same applies to all other websites linked via hyperlinks. The Sender is not responsible for the content of websites accessed through such links; responsibility lies solely with the respective operators. Furthermore, the Sender reserves the right to make changes or additions to the information provided.
3. Offers and Conclusion of Contract
All offers and information regarding offers are always non-binding and subject to availability. This applies to all information in our price lists, advertisements, promotional materials, informational texts of any kind, as well as oral or telephonic statements and commitments, except in cases of editorial errors, printing mistakes, or incorrect information due to faulty electronic data transmission.
A contract is concluded when the web order form is completed and submitted, an order card is sent via fax or post, or an order is placed by telephone, on one hand, and the order is confirmed or executed by the Sender on the other. Effective confirmation of a web order requires the customer to provide a valid email address as the contracting party, but it is also considered confirmed upon execution of the order.
4. Prices, Shipping Costs and Payment Terms
The list prices and conditions applicable at the time of the order in the chosen, current ordering medium (e.g., catalog or online shop at www.amorex.at, www.amorex.it, www.amorex.eu) apply.
There is no retroactive entitlement to a different price or different conditions from a medium other than the one selected. Errors and changes are reserved. The Sender reserves the right, in individual cases, to grant the customer a lower price.
Prices or conditions granted as part of special promotions (e.g., via advertisements, brochures, catalogs, the website www.amorex.at, or email newsletters) are valid for a limited period, starting from the announcement of the promotion by the Sender. The limitation is clearly communicated within the promotion. There is no entitlement to retroactive application of promotional prices or conditions.
All prices are quoted in EURO and include the legally required Austrian VAT, excluding packaging and shipping costs.
For packaging and shipping, the following costs are charged separately: there is no minimum order value. For deliveries within Austria and the EU, shipping costs of €11 apply. The stated amounts also include the legally required Austrian VAT.
Delivery is made to the address specified in the order. Shipping is carried out by a shipping partner (usually DPD or the Austrian Post).
Payments can be made online via PayPal or credit card through PayPal. The Sender reserves the right, in individual cases, to exclude certain payment methods. In such cases, the Sender will inform the customer immediately. Customers who do not use PayPal are asked to contact the Sender personally (phone, email, etc.) for payment by bank transfer.
Orders are accepted up to a maximum order value of €120. The Sender reserves the right to grant selected customers a higher individual credit limit. When paying by credit card, the customer authorizes the Sender to charge all amounts due to their credit card issuer. The customer provides PayPal with all necessary credit card information and ensures sufficient funds. The customer’s credit card is charged on the day of the order or the day the payment is made via PayPal. For credit card payments that are returned or canceled due to reasons attributable to the customer (e.g., incorrect credit card information, insufficient funds), the customer bears the resulting costs.
If the customer is in default of payment, the Sender reserves the right to charge default interest of 5 percentage points above the current base rate announced by the European Central Bank.
The goods remain the property of the Sender until full payment has been received.
5. Delivery, Performance and Shipping Obligations
Ordered products are shipped to the customer by parcel. Delivery is made to the customer, to the persons named by the customer in the order, or to persons living in the same household with the customer, unless the customer has explicitly excluded this in the order.
The risk of accidental loss or deterioration of the ordered goods passes to the customer only upon handover of the goods.
The Sender makes a non-binding effort to deliver the ordered goods within 2 to 4 business days from order confirmation. In practice, the goods are usually prepared and shipped immediately upon receipt of the order. The Sender assumes no liability for meeting delivery times or deadlines.
The Sender requests the customer to provide preferred delivery times. This information will be shared with the shipping partner to ensure successful delivery.
If delivery fails for reasons beyond the Sender’s control, the Sender is entitled to cancel the order. The customer has no right to claim damages against the Sender. Any payments already made will be fully refunded.
If a specific item is not available, no substitute items will be shipped. The customer will not incur any costs. The customer will be informed immediately if an ordered item cannot be delivered. There is no entitlement for subsequent delivery in case products cannot be supplied.
The Sender assumes no liability for the completeness of the order. Partial deliveries are permitted if full delivery is not possible because the goods are not immediately available and cannot be procured with reasonable effort. If a partial delivery is permanently unavailable, the customer will be informed immediately. The price payable will be reduced accordingly by the value of the undelivered goods. The remainder of the contract remains unaffected. Any additional costs associated with partial deliveries are borne by the Sender.
The Sender reserves the right to deliver only in quantities typical for household use and only to end consumers. For commercial orders, please contact us directly.
For distance sales, the Sender can only deliver the products listed on the website.
6. Right of Withdrawal and Returns
Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you, or a third party designated by you who is not the carrier, take possession of the last item.
To exercise your right of withdrawal, you must inform us:

of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or email). You may use the attached model withdrawal form, but it is not mandatory.
To meet the withdrawal deadline, it is sufficient that you send the notification regarding your exercise of the right of withdrawal before the withdrawal period expires.
Effects of Withdrawal
If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (except for additional costs arising if you chose a type of delivery other than the cheapest standard delivery offered by us), without undue delay and no later than fourteen days from the day we receive notice of your withdrawal. We will use the same means of payment that you used for the original transaction unless expressly agreed otherwise with you; in no case will you incur any fees for this repayment.
We may withhold reimbursement until we have received the goods back or you have provided proof of return, whichever occurs first.
You must return the goods to us without undue delay and in any case no later than fourteen days from the day on which you notify us of your withdrawal, to: Coropharm GmbH Kugelweg 37 9500 Villach
The deadline is met if you send the goods before the fourteen-day period expires.
You bear the direct cost of returning the goods.
You are only responsible for any diminished value of the goods if this loss is due to handling beyond what is necessary to inspect the nature, characteristics, and functioning of the goods.
Special Notes
The right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and for which individual selection or specification by the consumer is decisive, or goods clearly tailored to the consumer’s personal needs.
The right of withdrawal also does not apply to contracts for the delivery of goods that are perishable or whose expiration date would be quickly exceeded. This may apply to certain medicines and dietary supplements.
Furthermore, the right of withdrawal expires prematurely for contracts for the delivery of sealed goods that are not suitable for return due to health protection or hygiene reasons if the seal has been removed after delivery. Dietary supplements in blister packs, sealed cans, or other sealed containers are considered such goods. The right of withdrawal expires if the seal has been removed or blister packs opened after delivery.

7. Warranty and Claims for Defects
In the event of a defect, the Sender is initially obliged, due to the nature of the goods, to replace the item. If the replacement fails due to reasons for which the Sender is responsible, the customer is entitled to request a price reduction or to withdraw from the contract.
The defect must be reported to the Sender in writing immediately upon receipt of the goods, and no later than seven business days after becoming aware of the defect. The deadline is met if the customer sends the notification within this period.
When making a warranty claim, the defective item must be returned sufficiently prepaid. Unpaid returns cannot be accepted. In the case of a justified defect, the Sender will reimburse the shipping costs. To ensure clear identification, allocation, and processing of the replacement, a copy of the invoice or a letter with the customer and invoice number must be included.
No claims for damages arise against the Sender in the event of a defect unless the damage was caused by intent or gross negligence.

9. Severability Clause
If any provision of these Terms and Conditions is or becomes invalid, it shall be replaced by a legally permissible provision that most closely reflects the original intent. All other provisions shall remain in full force and effect.
10. Governing Law and Jurisdiction
The contracting parties agree that, with regard to all legal relationships arising from this contractual relationship, both current and future after the fulfillment of the contract, the national law of the country from which the goods are shipped shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
